Non-payment for work performed

This case was about the financial settlement after work on a home. The defendant requested crafting services on the “My Tender” website. After the work had been carried out, a dispute arose over the financial settlement. Over NOK 120,000 in bills were outstanding after the work was completed. The defendant, on the other hand, believed that there were shortcomings and delays, and contacted the Oslo lawyers to assist in the case. Since the counterclaim exceeded the main claim, the defendant won the case.

Defective work performed

The defendant in this case believed that the craftsmen had carried out defective work. Among other things, it was re-insulated, but air leaks were still found. Furthermore, the craftsman service has ordered the wrong dressing. The craftsmen also caused a crack in a window of the home. Finally, there were also errors with ventilation pipes and gutters. The court concluded that the defendant was entitled to a price reduction and compensation of over NOK 300,000. This amounts to around NOK 200,000 after deductions have been made for the unpaid invoices.

The counterclaim exceeded the main claim

The original claim to the plaintiff was around NOK 130,000. The counterclaim that the defendant won with was around NOK 230,000. The counterclaim of the defendant thus exceeded the original main claim of the plaintiff. This resulted in the plaintiff having to pay the defendant over NOK 200,000, and late payment interest. The defendant thus won the case completely.

Interest on late payment of work

Late payment interest occurs when someone who has an obligation to pay does not pay as it should. Late payment interest can also occur when work or other agreements are delayed. The purpose of interest on late payment is to compensate for losses and to prevent breach of agreements. Late payment interest can be claimed for all types of contracts. In this case, the defendant demanded late payment interest because the work was not finished at the time it was agreed upon. The defendant prevailed on this, and was awarded default interest.

Case costs

Our client won the case completely. The other party must therefore pay court costs of an additional NOK 73,000.
